Terms and Conditions for Texan Wood Shutters & Shades

1. Agreement to Terms

Welcome to Texan Wood Shutters & Shades. These Terms and Conditions ("Terms") constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and Texan Wood Shutters & Shades ("we," "us," or "our"), concerning your purchase of our products and installation services. You agree that by placing an order with us, you have read, understood, and agree to be bound by all of these Terms and Conditions.

2. Our Services

We provide custom-made window treatments, including but not limited to wood shutters, shades, and blinds ("Products"), and professional installation services. All Products are custom manufactured to the unique specifications and measurements of your property.

3. Estimates, Orders, and Measurements

• Estimates: All estimates provided during a design consultation are based on initial measurements and product selections. The estimate is valid for a period of 30 days.

• Final Measurements: Before fabrication, our professional technician will take final, precise field measurements. Your final order price will be based on these official measurements. You are responsible for ensuring our technicians have safe and clear access to all windows.

• Order Confirmation: Production on your custom order will begin once you have signed the final order agreement and the required deposit has been paid.

• Custom Nature of Products: You acknowledge that all Products are custom-made to your specific requirements. As such, once an order has been placed into production, it cannot be canceled, and deposits are non-refundable.

4. Payment

A deposit of 50% of the total order price is required to commence production of your custom Products. The remaining 50% balance is due in full upon completion of the installation. We accept payment by major credit cards, checks, and other methods as specified on your invoice.

5. Installation

• Scheduling: We will contact you to schedule a professional installation date once your custom Products have been fabricated. While we strive to meet all estimated timelines, fabrication and installation dates are estimates and not guaranteed.

• Site Preparation: It is your responsibility to prepare the installation site by removing any old window treatments, furniture, or obstacles that may impede our installers' work.

• Completion: Installation will be deemed complete upon the final fitting of the Products. You agree to inspect the work with our lead installer and sign a certificate of completion.

6. Warranty

We are proud to stand behind our products and services. Our custom shutters are covered by a Lifetime Warranty, and all other shades and blinds are covered by a 5-Year Warranty, "for as long as you own your home." This warranty covers defects in materials and workmanship. This warranty does not cover damage resulting from misuse, accidents, alterations, or normal wear and tear. 7. Limitation of Liability

In no event will we or our directors, employees, or agents be liable to you or any third party for any direct, indirect, consequential, exemplary, incidental, special, or punitive damages arising from our products or services. Our liability to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to us for the products and services.

8. Governing Law

These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles.

9. Changes to Terms

We may modify these Terms and Conditions at any time. The updated version will be indicated by an updated "Last Updated" date. You are responsible for reviewing these Terms periodically.
